Efficiency of labor dispute resolution mechanisms (a law and economics analysis)

Labor rights become valid in practice only through accessible and efficient dispute resolution mechanisms. Although the Constitution states that every individual has the right to access the court and protect their rights, in practice, citizens are tend to avoid their right to litigation due to high implementation costs and numerous procedural challenges. In 2023, approximately 1,800 labor disputes were registered in Mongolia, with an average resolution time exceeding 200 days. The institutional framework for labor dispute resolution in Mongolia is integrated into the general court system rather than through unified, specialized courts. Civil courts are responsible for a wide range of disputes, including labor, contracts, property, loans, debts, complaints, and family law. This leads to several issues such as delays in the resolution process, prolonged trial durations, excessive judicial workloads, and a decline in the quality and accessibility of judicial decisions. As a result, both employees and employers perceive the cost of exercising their rights as prohibitively high, which serves as a primary reason for opting out of the legally guaranteed right to a fair trial. This article analyzes labor rights disputes from the perspective of Law and Economics theory, examining the correlation between the costs of enforcing labor rights, the right to a fair trial, and the judicial efficiency of the resolution system. Furthermore, by comparatively analyzing different resolution models—specifically specialized labor courts versus general civil courts—this study proposes an analytical framework to evaluate the effectiveness of labor dispute resolution mechanisms. This paper establishes the theoretical framework for the author's research and serves as the foundation for subsequent empirical studies.
Хөдөлмөрийн маргаан шийдвэрлэх механизмын үр ашиг (Эрх зүйн эдийн засгийн онолын шинжилгээ)
Хураангуй: Хөдөлмөрлөх эрх нь маргаан шийдвэрлэх хүртээмжтэй, үр ашигтай механизмаар дамжин бодит амьдралд хэрэгжих боломжтой болдог. Үндсэн хуульд хүн бүр шүүхэд хандах, эрхээ хамгаалуулах эрхтэй хэмээн заасан боловч практикт энэхүү эрхээ эдлэх хэрэгжилтийн зардал өндөр, процессын шинжтэй олон асуудал тулгамдаж байгаагаас иргэд хөдөлмөрлөх эрхээ бодитоор хэрэгжүүлж чадалгүй шүүхэд хандах эрхээсээ татгалзах тохиолдол ихсэж байна. 2023 онд хөдөлмөрийн маргаан 1800 орчим бүртгэгдэж, дундаж шийдвэрлэх хугацаа 200+ хоног байсан. Монгол Улсад хөдөлмөрийн маргаан шийдвэрлэх институцийн бүтэц нь нэгдсэн, дагнасан шүүх бус, ерөнхий шүүхийн тогтолцоонд харьяалагддаг. Иргэний хэргийн шүүх нь хөдөлмөр, гэрээ, өмч, зээл, өр, гомдол, гэр бүл гээд олон төрлийн маргааныг хариуцдаг. Үүнээс үүдэн хөдөлмөрийн маргааныг шийдвэрлэх процесс удаашрах, хэрэг шийдвэрлэх хугацаа уртсах шүүхийн ачаалал хэт их байх, шийдвэрийн чанар, хүртээмж сулрах зэрэг хүндрэлүүд үүсэж байна. Үүний үр дүнд ажилтан, ажил олгогч хоёрын аль аль нь эрхээ эдлэх зардлыг өндөр гэж үнэлэх болсон бөгөөд хуулиар олгогдсон эрхээ бодитоор эдлэх буюу шүүхэд хандах эрхээсээ татгалзах шалтгаан болж байна. Энэхүү өгүүлэлд хөдөлмөрийн эрхийн маргаан буюу ганцаарчилсан маргааныг эрх зүйн эдийн засгийн онолын үүднээс шинжилсэн бөгөөд хөдөлмөрлөх эрхээ хэрэгжүүлэх зардал, шударга шүүхээр шүүлгэх эрх болон хөдөлмөрийн маргаан шийдвэрлэх тогтолцооны шүүхийн үр ашигт байдал хоорондын хамаарлыг авч үзэн, улмаар хөдөлмөрийн маргааныг хянан шийдвэрлэх загварууд, тухайлбал төрөлжсөн хөдөлмөрийн шүүх болон иргэний хэргийн ерөнхий шүүхүүдийг харьцуулан шинжилснээр хөдөлмөрийн маргаан шийдвэрлэх механизмын үр нөлөөг үнэлж, тулгамдаж буй асуудлыг даван туулах арга замыг тодорхойлохыг зорьсон болно.
