Artificial intelligence and copyright: new legal challenges in the digital era

Abstract

The rapid advancement of digital technologies, particularly the widespread adoption of artificial intelligence (AI)-based systems, has introduced significant challenges to the traditional understanding of intellectual creation and the legal regulation of copyright. AI-driven and generative technologies now enable the creation of various forms of content, including text, images, and music, with varying degrees of human involvement or, in some cases, autonomously. This development raises fundamental legal questions concerning authorship, eligibility for copyright protection, and the scope of applicable legal safeguards.

The purpose of this study is to examine the legal nature of works created with the involvement of artificial intelligence, analyze copyright-related challenges, and comparatively assess the legal framework of Mongolia in light of international developments. The research employs doctrinal legal analysis, comparative legal methods, and document analysis.

The findings reveal that the determination of authorship in AI-assisted works largely depends on the extent of human creative contribution. However, the existing copyright framework remains insufficient to address the emerging legal complexities associated with such works.

This study concludes that it is necessary to clarify the legal status of AI-assisted works and to further refine the scope of copyright protection within the current legal system. The research contributes to ongoing academic and policy discussions on adapting copyright law to the evolving digital environment. This study is of both theoretical and practical significance in that it examines copyright issues related to AI-assisted works within the context of Mongolia’s legal framework. Furthermore, the study demonstrates scholarly originality by identifying the necessity for legal reforms aimed at strengthening the protection of intellectual property rights in the digital environment.

Хиймэл оюун ухаан ба зохиогчийн эрх: дижитал эрин үеийн эрх зүйн шинэ сорилт

Хураангуй: Дижитал технологийн хурдацтай хөгжил, ялангуяа хиймэл оюун ухаанд суурилсан системүүдийн өргөн хэрэглээ нь оюуны бүтээл бий болгох уламжлалт ойлголт болон зохиогчийн эрхийн эрх зүйн зохицуулалтад шинэ сорилт бий болгож байна. Хиймэл оюун ухааны алгоритм болон генератив технологи ашиглан текст, дүрслэл, хөгжим зэрэг бүтээлийг хүний оролцоотой болон зарим тохиолдолд бие даан бий болгох боломж нэмэгдсэн нь “зохиогч”-ийг тодорхойлох, зохиогчийн эрх олгох боломж, эрхийн хамгаалалтын хүрээг дахин авч үзэх шаардлагыг бий болгож байна.

Энэхүү судалгааны зорилго нь хиймэл оюун ухааны оролцоотойгоор бий болсон бүтээлийн эрх зүйн шинж чанарыг тодорхойлох, зохиогчийн эрхийн хамгаалалтын асуудлыг судлах, улмаар Монгол Улсын эрх зүйн зохицуулалтыг олон улсын эрх зүйн хөгжлийн чиг хандлагатай харьцуулан дүн шинжилгээ хийхэд оршино. Судалгаанд эрх зүйн шинжилгээний арга, харьцуулсан эрх зүйн арга болон баримт бичгийн судалгааны аргыг ашигласан.

Судалгааны үр дүнгээс үзэхэд хиймэл оюун ухааны оролцоотой бүтээлд зохиогчийг тодорхойлох асуудал нь хүний бүтээлч оролцооны түвшинтэй шууд холбоотой бөгөөд одоогийн зохиогчийн эрхийн эрх зүйн зохицуулалт нь ийм төрлийн бүтээлийг бүрэн хамарч чадахгүй байна. Иймд хиймэл оюун ухааны оролцоотой бүтээлийн эрх зүйн статусыг тодорхой болгох, зохиогчийн эрхийн хамгаалалтын хүрээг нарийвчлан тодорхойлох шаардлагатай байна. Энэхүү судалгаа нь хиймэл оюун ухааны оролцоотой бүтээлийн зохиогчийн эрхийн асуудлыг Монгол Улсын эрх зүйн орчинтой уялдуулан авч үзсэнээрээ онолын болон практик ач холбогдолтой бөгөөд дижитал орчин дахь оюуны өмчийн эрхийн хамгаалалтыг боловсронгуй болгох эрх зүйн шинэчлэлийн хэрэгцээг тодорхойлсноороо шинэлэг ач холбогдолтой юм.
